Storm Damage and Old Buildings Around Hayesville

Helene put Clay County in a federal disaster declaration in September 2024. When a storm leaves a barn or a garage past repair, we take it down with an excavator. Downed trees and storm debris get cleared and hauled off in our dump truck.

Close to one Clay County home in four is held for seasonal or occasional use, by the Census Bureau's survey. Live out of town part of the year? Call or text with the address and what has to come down. We set a time to look at the job, and you get the quote in writing.

Do You Need a Permit to Tear Down a House in Hayesville?

Yes: state law calls for a permit before a house comes down, and the Clay County Building Department issues it. That office sits in Hayesville, the county seat. Inside the town limits and a one-mile area around them, the Town of Hayesville handles zoning too. A building permit for a new house there waits on the town's certificate of zoning compliance.

FEMA maps high-risk flood zones, marked AE, along the Hiwassee River and Town Creek around Hayesville. Clay County requires a Floodplain Development Permit for any project in an AE zone. Its floodplain manager works in the Building Department. On low ground near the river, ask about the flood map before a tear-down or any grading.

North Carolina law calls for notice to NC 811 at least three full working days before any demolition or digging. The utilities mark their public lines, but 811 does not mark private ones. Show us where the well line runs and where the septic tank sits before the excavator starts. Our guide to demolition permits in North Carolina covers the state steps.

Lake Chatuge Lots and TVA Shoreline Rules

Lake Chatuge is a reservoir run by the Tennessee Valley Authority, or TVA. It sits on the Hiwassee River a few miles upstream from Hayesville. It runs 13 miles from Chatuge Dam into north Georgia. In a normal year, the lake level swings about 10 feet between summer and winter for flood storage.

Under Section 26a of the TVA Act, building along the shoreline takes TVA's approval first. That covers docks and shoreline stabilization work, such as a wall at the water's edge. Ask TVA where its land and easements run before any work near the water.

TVA allows a shoreline retaining wall only where erosion is severe and a wall is the most effective fix. A wall that connects to a TVA-approved wall on the lot or next door can qualify too. Up the slope, retaining walls hold house pads and driveways on steep lake lots.

Site Work for a New House Near Hayesville

Clay County grew from 11,089 people in the 2020 Census to an estimated 12,239 in 2025. The Census Bureau counted permits for 137 new single-family homes in the county in 2024, and 108 in 2025. A new house on a wooded lot starts with site development. We clear the lot, then the excavator cuts in the driveway and the house pad.

Hayesville sits on the wide river bottom of the Hiwassee River, at about 1,850 feet. The town's land use plan says slopes in the rest of Clay County are mostly steep. A soil series shares the town's name: the Hayesville series, with red clay under a loam topsoil. Soil scientists described its reference profile in a road cut about 2.5 miles southeast of town.

Disturbing more than one acre takes an approved erosion and sedimentation control plan under state law. Clay County is not on the state's list of local erosion programs, so NC DEQ reviews that plan. State law also calls for ground cover on exposed slopes within 21 calendar days after any phase of grading ends. Hydroseeding is one way to get grass growing on bare ground.

Hayesville FAQ

Questions We Hear Around Hayesville

A few of the questions we hear most around Hayesville. If yours is not here, call or text and ask.

Call (828) 342-1467

What has to happen before a house comes down in Clay County?
For a house, the state's Health Hazards Control Unit recommends an asbestos inspection before demolition. Commercial buildings fall under federal asbestos rules, and those need notice to the state at least 10 working days ahead. You have the utility shut off power and gas before the tear-down. Clay County's transfer station lists asbestos among the things it does not accept.
What does it cost to tear down a house near Hayesville?
Every job is priced after we look at it. The size of the building and what it is built from count the most. A basement or a slab adds work, and so does a steep drive on a hillside lot. You get the quote in writing before any work starts.
Can you clear trees on a Lake Chatuge lot?
On land you own, yes. We handle tree removal there and haul the wood and brush off. If the strip along the water belongs to TVA, cutting there takes TVA's written permission first. On TVA land, a 50-foot shoreline management zone keeps trees standing unless TVA approves.
Who answers well and septic questions on a tear-down lot near Hayesville?
Most people in Clay County get their water from private wells, the town's land use plan says. Clay County Environmental Health is the office for well and septic questions. The county wants that office's approval on a well or septic system before it issues a building permit. A new house outside the old footprint near an existing septic system needs that approval too.
Do you work outside the Hayesville town limits?
Yes. We take jobs across Clay County, including Tusquittee, Shooting Creek, Brasstown and Warne. Across the Georgia line, we also work around Hiawassee and Young Harris. It is all part of the tri-state area around our base in Murphy.
